§ 1 Scope and Provider

These Terms & Conditions are valid for all orders that private customers order through the online shop of the Association Suisse der Hunde-Trainer for e-Learning, 6315 Morgarten/ZG

§ 2 Contract signing and withdrawal

§ 2.1 The representations in the online store are intended to submit a purchase offer. By clicking on the button “Order now”, you agree to a binding purchase offer. The sale of our services or products is only intended for personal use in usual amounts.

§ 2.2 We can accept your order via an order confirmation via email or via delivering the product within 5 days. The order confirmation does not equal acceptance of the purchase offer.

§ 2.3 Should our order confirmation contain any written or printed errors or should our price be subject to technical transmission errors, we are entitled to contesting the incorrectly listed price by notifying you of the mistake. Payments already made for such incorrectly priced items will be refunded immediately.

§ 2.4 A withdrawal or a cancellation of the contract before shipping the certificate of competence can be applied for by the participant.The board decides in its sole descretion whether a cancellation is offered in this case. Such an offer by the board has to be accepted within a week by payment of an expense allowance in the amount of CHF 60 instead of the course fee by the participant, otherwise the possibility of the cancellation expires. In the case of unsuccessfull reminders the total amount will be driven up.

§ 3 Prices

The prices mentioned on the web shop pages include VAT and other price components and are without shipping costs. With our distance courses, there is no VAT or shipping cost, so you will not have any further costs.

§ 4 Shipping costs

§ 4.1 For the shipping of products we calculate the shipping costs individually per order.

§ 4.2 For cash on delivery orders, there is an extra fee that the delivery agent will charge on site. No further costs or taxes will be charged.

§ 5 Delivery Conditions & Self-Supply reservation

§ 5.1 Shipping goes through the Swiss Post.

§ 5.2 The shipping time is ca. 1-3 days, unless otherwise stated.

§ 5.3 Should an ordered product be unavailable, we may make a partial delivery of items that are available at our expense if acceptable to you.

§ 5.4 Should the delivery of the products fail three times, we may resign from the contract. Any payments already made will be refunded.

§ 5.5 If the product ordered is not available, due to it not being available from our suppliers for reasons beyond our control, we may withdraw from the contract. In this case, we will inform you immediately and suggest a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will refund any amounts already paid without delay.

§ 6 Terms of Payment

§ 6.1 Payment is made either in advance, per direct bank transfer, PayPal or credit card.

§ 6.2 If you choose to pay in advance, we will give you our bank information in the order confirmation. The invoice amount is to be paid within 7 days into our account. If you pay with a credit card, we will charge your account when you order the course.

§ 6.3 In the event of payment default, we will charge 5% interest over the base rate. We reserve the right to show and enforce a higher delay damage.

§ 6.4 If you pay via direct debit, you are responsible for any costs occurring due to a transaction reversal due to insufficient funds or wrong bank information.

§ 6.5 You only have the right to offsetting if your counter-claims have been established in court or are undisputed or are recognized by us in writing.

§ 6.6 You can only exercise the right of retention as long as the claims result from the same contractual relationship.

§ 6.7 In the Internet business, we routinely do not send any bills or a red deposit slip via post. The bank information can be found in the web shop, in the order confirmation and in the eLearning course. If you require a paper bill, we will charge an additional fee of CHF 10.

§ 6.8 Should you not have paid after several reminders, the outstanding balance will be pursued. In that case we charge an additional fee of CHF 60.

§ 7 Retention of Title

The products continue to be our property until full payment has been received. A pledge, transfer of ownership, processing or redesign before the transfer of ownership is not allowed without our consent.

§ 8 Transport Damage

§ 8.1 If you receive products with obvious transport damages, please complain about such errors right away with the delivery agent and contact us immediately via 041-5120022 (Andreas Gross, Dipl.-Ing.).

§ 8.2 The failure of a complaint or contact to us has no consequences for your statutory warranty rights. But you would help us assert our own claims towards the carrier or the transport insurance.

§ 9 Warranty

The warranty is subject to the statutory provisions.

§ 10 Liability

We hereby disclaim all liability for negligence, provided such breaches do not relate to contractual obligations, damages resulting from injury to life, body or health or guarantees or claims under the Product Liability Act. The same applies to violations of our agents and fiduciaries.

Direct or indirect references to external websites (the “Hyperlinks”) are outside our responsibility and we are not liable for any of the contents thereof. We hereby expressly declare that, at the time of linking, no illegal content is contained on the linked pages.

However, the current and future design, contents or authorship of the Hyperlinks is beyond our control and we therefore disclaim all liability for any contents therein after the time of linking. This statement applies to all Hyperlinks and references as well as foreign entries in guest books, discussion forums, link directories, mailing lists and all other forms of databases to which external write access is possible. For illegal, incorrect or incomplete contents or if damages arise or result from the use or disuse of such information, all liability will lie solely with the party responsible for creating or providing such content, not the party providing the link thereto.

§ 11 Copyrights & Trademarks

eLearning course publications contain original works of authorship, such as graphics, sound documents and video sequences to which eLearning course owns all copyright. Additional royalty-free or licensed materials may also be incorporated into eLearning course publications and ownership of any such materials are expressly disclaimed. All trademarks are protected by applicable trademark laws and are the property of their respective owners. Use of such trademarks does not imply that they are not protected by third party rights. The author hereby retains sole and exclusive ownership of any original works of authorship. Any duplication or use of such graphics, sound documents, video sequences and texts in other electronic or printed form is not permitted without the express prior written permission of the author.

§ 12 Final Provisions

§ 12.1 If a student attempts to navigate any course by means of deception or fraud, the instructor has the right to refuse to issue a certificate of competence. In such event, the course fee will still be due and payable.

§ 12.2 If any provision of these Terms is declared invalid, the remainder of the contract shall remain valid and in full force and effect. Any provisions declared invalid will be automatically replaced by the relevant statutory provisions.

§ 12.3 These terms will be governed by Swiss law. Any litigation will be conducted exclusively in the German language. In case there is a difference in the English version of these terms to the German version: Only the German version is valid.

§ 12.4 Jurisdiction in Zug / ZG.

End of Terms
